I really don’t see much harm in trying to get it through a Dallas bankruptcy ….you can always convert to a 13 and I believe no one would argue that there wasn’t good faith. (is it just me or does that sound like a double negative? lol) I think your problem with the UST will center around the idea of permanence and recovery. UST and have no clarity anywhere else. I recently butted heads with our Dallas bankruptcy UST when I filed a Chapter 7 for a Nurse whose home was going into foreclosure and she and all other nurses were on strike and been out of work for over 8 months. Mental health expense fits into the medical category the same way OTC drugs, vitamins and supplements do. I would ask about getting a briefly statement from the psychologist addresses the necessity of the treatment and reasonableness of the charges and be prepared to share it with the trustee at the 341. Most of our local Dallas bankruptcy trustees would appreciate a brief email as a heads up.
